Your Privacy Rights

Dayton-Granger, Inc. (“DG”) is committed to protecting the privacy of individuals who access this website (“Site”) as well as any other online service that links to or refers to it (collectively, the “Services”). In accordance with this commitment, DG has developed the following Privacy Policy (“Policy”). This Policy describes the information we collect, how we use and disclose it, with whom we share it and the choices users of the Site and Services may exercise with regard to the use of the information. By accessing this Site, you are consenting to the information collection and use practices described in this Privacy Policy. If you do not agree to the terms of this Policy, please do not use this Site or the relevant Services.

Information We Collect and Store.

Information You Provide Directly

The types of personal information users of our Site or Services may submit include:

Contact information. We collect such information, including your name, postal address, telephone number, and email address when you email us or submit comments or questions using the Contact Us form on our Site or if you provide us with responses to a survey. Your email address as well as any information, characters, graphic information or other files contained in the message are also collected.
Login credentials and information used to access the Site and Services.
Employment information. Your job title, division, employer, and military rank, if applicable.
Personal information of suppliers. This may be supplied to us in order to properly evaluate and select current and potential suppliers and subcontractors. Such information may include, social security number, diversity-related information (such as ethnicity and gender), federal tax identification number, disability status, and relevant civil and criminal history.
Personal information of job applicants. This includes any information listed on a resume, C.V. or cover letter submitted to DG via email to Careers@daytongranger.com as well as personal and employment history information entered by applicants directly onto this Site via the Careers page. Such information may include current and past employers, salary history, education level obtained, work authorization information, citizenship information as well any voluntary disclosure of information regarding a candidate’s race, ethnicity, gender, veteran and disability status. If your application or inquiry is not successful, we will retain your information or resume for future consideration for a limited period of time unless you request otherwise. Information We Collect Automatically

Site Activity. In order to evaluate the content DG features on this Site, make improvements, and to allow for technical administration of the Site, DG utilizes various digital analytics tools, which monitor site activity and allows the Company to collect and store information about visits to the Site. This information is collected and stored anonymously from users. Such information does not identify individual users or include any personally identifiable information. DG collects this information solely for improving the Site and does not utilize such information for commercial purposes.Examples of information collected automatically from this Site and the Services include the following:

Device Information. Your device type, operating system type, browser type, IP address, MAC address, approximate physical location, the specific webpages visited during your connection, and the domain name from which you accessed the Site or Services.
Interaction with the Site and Services. Information regarding your usage of the Site and Services, such as the areas or pages of the Site or Services that you visit may be logged through the use of web beacons.
Cookies. A “cookie” is a small text file that is placed on a visitor’s computer or device by a website server after accessing a website. A website can only store and read its own cookies. Additionally, a cookie cannot read data from elsewhere on a visitor’s computer. DG may utilize cookies on this Site in order to help improve visitors’ access to the Site, make note of repeat visitors, track the interests of visitors, and provide a secure, personalized browsing experience for visitors. Cookies utilized on this Site may collect information about how visitors use this Site, which site the visitor came from, the number of visits and how long a visitor stays on the site.

Our site currently does not recognize browser “Do Not Track” signals; however, users can choose to receive notifications when cookies are received and disable cookies by modifying their web browser settings. Information from Third Parties

To the extent permitted by applicable law, we may receive additional information about you through either publically or commercially available third-party sources. This information includes personal data such as your name, address, email address, preferences, interests, and demographic data. We combine such personal information received from third party sources with the information we collect via our Site and Services and utilize, store and protect such data in accordance with this Policy.

Use of the Information We Collect

We may use the information provided by users as set forth above for any of the following purposes:

providing DG products and services;
assisting users in utilizing the Site and Services;
responding to customer inquiries, providing follow-up communication to customers and potential customers, and recommending products and services;
obtaining user feedback and administering customer surveys;
evaluating and onboarding job applicants by reviewing qualifications, verifying candidate information, and conducting reference and applicable background checks;
selecting and evaluating suppliers and subcontractors to ensure compliance with DG’s requirements, obligations to customers, and applicable laws, rules and regulations;
implementing improvements to DG’s products and services as well as the Company’s business processes;
conducting data analysis and internal audits;
carrying out of DG’s cybersecurity and other security functions and controls; and
other purposes, provided that affected users receive a specific notice of such uses.

Sharing of Your Information.

DG will not rent, sell or trade any personally identifiable information obtained by third party sources or provided by users to any third parties. DG will not disclose any of the submitted information outside of the Company and its authorized representatives with the exception of the following limited circumstances.

Service Providers. DG utilizes other companies to provide Site maintenance services, which may include web hosting and analysis of Site activity. DG will only provide these companies with the portions of any personal information that are necessary to carry out such services.
Legitimate Requests and Protection of Business. DG may access and disclose any information it deems necessary and appropriate in order to comply with legitimate governmental requests, subpoenas, or court orders. DG may also disclose such information if necessary to protect the interests of its business, its systems or its customers. Such instances may include, prevention of fraud, enforcement of DG policies, preservation of the Company’s rights, as well as the protection of DG’s employees, customers, and property.
Corporate Structure Changes. Such information may be disclosed pursuant to a sale or transfer of all or a portion of DG or its assets to a third party, including in the event of a reorganization, merger, dissolution or liquidation.
Consent. Information may be shared if you or your company provide consent to a specific request to disclose from DG.

Security.

We maintain administrative, technical and physical safeguards, which meet industry standards, to protect against unauthorized disclosure, use, alteration or destruction of any personally identifiable information in our possession. Additionally, we provide security controls in an effort to protect the information you submit online. However, the internet cannot be guaranteed to be 100% secure, so we cannot ensure the security of all personal information received by DG.

Storing Your Personal Data.

DG will store your personal data for as long as reasonably necessary with regard to the purpose for which it was collected. In some instances, we may be required to store your personal data for an extended period of time in accordance with applicable legal, regulatory, tax, accounting or other compliance-related requirements. Additionally, your data may be stored by DG for record-keeping purposes should the Company anticipate any litigation related to your personal data or interactions with you.

Third Party Websites.

DG may provide links to access third party websites on the Site. These websites are governed by separate privacy policies and conditions that are independent of DG. Accordingly, DG shall not be held responsible or liable with regard to the collection of personal information or the security or privacy of the stored information on such third party websites.

Additional Information for Specific Users.

Children, Parents, and Guardians. This website is intended for visitors who are at least 18 years of age and the age of majority as defined by local law. DG does not knowingly collect, use or store personal information about children nor does it knowingly market products or services to children. If you do not meet the age requirements referenced above, please do not enter your personal information on this Site or via any of the Services.

Residents of California. If you are a California resident, you may be entitled to additional rights regarding your personal information. Such rights are set forth below. These rights are supplemental and incorporated into this Policy.

California Shine the Light Law. Pursuant to this law, a business is required to disclose upon a customer’s request (limited to one request per calendar year): (1) the types of personal information the business shared with third parties for the third parties’ direct marketing purposes during the immediately preceding calendar year; and (2) the identities of the third party companies with which the business shared such personal information. Under the California Shine the Light Law, “customers” are defined as California residents with an established business relationship with a company and provide personal information to a business at the creation of or throughout the duration of the established business relationship. DG does not share your personal information with third parties to be used for their own direct marketing.

California Consumer Privacy Act.

The California Consumer Privacy Act of 2018 (“CCPA”) creates a number of privacy rights that are applicable to consumers who are residents of California and addresses personal information we collect. This notice shall serve as DG’s disclosures required pursuant to the CCPA.

This CCPA Notice does not apply to:

Employment-related personal information collected from employees, job applicants, contractors, or similar individuals;
Individuals whose information we have due to their relationship with DG employees and contractors (e.g. employees’ dependents on DG’s health insurance plans and those listed as employee emergency contacts);
Personal information received as the result of a business-to-business communication or relationship; or
Other personal information exempt or not governed by the CCPA and its implementing regulations.

It is your right to know what kinds of personal information DG is collecting and the business purposes for such collection. It is your right to know how your personal information is obtained, how it is used, and DG’s business purpose behind such use. How Your Personal Information is Shared

It is your right to know how your personal information is shared with any third parties. As set forth above, DG may share or provide access to personal information: (1) as necessary for Service Providers to perform maintenance services for the Site, including web hosting and analysis of Site activity; (2) in response to legitimate governmental requests, subpoenas, and court orders and in order to protect the interests of its business; (3) pursuant to a change in corporate structure or ownership; and (4) in any specific instance where you provide consent. DG Does Not Sell Your Personal Information

It is your right to know whether your personal information is being sold. DG does not sell your personal information to third parties for monetary or any other valuable consideration.

Your CCPA Rights to Know and Delete

As a California resident, you have the right to request details about the personal information that we have about you, including the categories of information, the purpose for which we use it, with whom we share it, and specific information about what personal information we have about you specifically; and request that your data be deleted. Because DG does not sell personal information, we have not listed the CCPA rights for directing a company not to sell personal data.

Asserting CCPA Your Rights

In your email, be sure to include: (1) your full name; (2) a way to DG to contact you and respond to your request, such as your email address or telephone number; (3) details regarding the nature of your relationship with DG, for example a visitor to DG’s Site; and (4) information regarding what type of action you would like DG to take.

We will then investigate your request by determining if we have any of your personal information. If we have your personal information, other than that which you provided in your emailed request, we will take steps to verify your identity, which may require you signing a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request. Once we verify your identity, we will provide you with a response, stating how we will satisfy your request or why we cannot comply with a requested action.

If you choose to exercise any of your rights under the CCPA, DG is prohibited from discriminating against you for exercising such rights.

Users from the European Union.

Subject to certain exemptions, if you are a citizen or resident of the European Union, you have certain rights in relation to your personal data.

The right to rectification. You have the right to request that we correct any information you believe to be inaccurate as well as to request that DG complete any information you believe is incomplete. We may seek to verify the accuracy of the personal data before rectifying it.

However, we will continue to process your personal data should we: (a) have your consent; (b) need your data to establish, exercise or defend legal claims; or (c) need your data to protect the rights of another natural or legal person.

The right to object to processing. Under certain conditions, you have the right to object to DG’s processing or your personal data.

The right to transfer your personal data. Under certain conditions, you have the right to request that DG transfer your collected personal data directly to you or to another organization.

The right to not be subjected to automated decision-making. You will not be subject to decisions that will have a significant impact on you based on automated decision making, unless we have a lawful basis to do so.

Subject to legal and other permissible considerations, DG will make every reasonable effort in order to comply with your request or will promptly inform you if we need additional information from you, including information needed to confirm your identity. Please be aware that there may be other rights, confidentiality obligations and duties to others, which may prevent us from fully addressing your request. DG will investigate and put forth all reasonable efforts in order to comply with your requests to exercise the rights set forth in this Section within the timeframes required by applicable laws.

The right to lodge a complaint with your local supervisory authority. You have a right to lodge a complaint with your local supervisory authority in the event you have concerns regarding our processing of your personal data.
